Definitions
- We, our, us or Freosan Studios refers to Freosan Studios Pty Ltd (ABN 94679870556), a limited liability company incorporated in Australia.
- Site or the Website refers to any website operated by us.
- You, your, yourself or the user refers to the user who will accept this Terms of Use.
- Wiki or wikis refers to any subpage of the Website that is rendered using MediaWiki.
Relevant legislature
Freosan Studios is an Australian organisation. That means that Australian law governs any use of our Website, regardless of the country you originate from.
Scope
These Terms of Use encompass all relations between you, and Freosan Studios. This includes any use of the Website, or use of any software that is developed by us.
Prohibited behaviour while using our Site
You agree that you will not:
- Attempt to circumvent any electronic defence of our Sites or servers,
- Attempt to dox or out any other user of this Website,
- Engage in paid posting or editing without informing us or any other user,
- Use the Website for activities that are illegal under Australian laws, such as encouraging self harm or uploading copyright infringing material,
- Upload media that is illegal under Australian law, such as child pornography or files designed to damage receiving computers (whether of Freosan Studios or any of our clients),
- Threaten to take legal action against another user or Freosan Studios, or use our Websites while you have outstanding legal threats or legal action, except to the minimum extent possible to gather evidence for a legal proceeding (while we cannot stop you from exercising your right to take legal action, you may not use our Websites while doing so), or
- Intentionally violate the Privacy Policy for another user by looking at their personal details, for example, by unauthorised use of the CheckUser tool,
Copyright
Except where otherwise stated, the copyright on all non user generated content on the Website belongs to Freosan Studios. All rights reserved.
Should you find that your copyrighted material has been infringed on our Website, you must send us an Australian Takedown Notice. Since we are an Australian organisation, Digital Millennium Copyright Act (DMCA) takedown requests are not valid and will be ignored.
Special terms regarding wikis
The content on wikis are user-generated content. All content is the property of their respective owners, licensed under the CC BY 4.0 license, which permits reuse provided the terms of the license are met.
Additionally, by publishing content of your own to the wiki (by clicking the "Save changes" button), you agree to release your contributions under the CC BY 4.0 license.
Nothing in this section shall be taken to imply that any other content on the Website is released under the CC BY 4.0 license, unless explicitly stated.
Hotlinking
Downloading of images and other assets from the Website in order to incorporate them as a part of another website is not permitted. However, where assets are given under a license that permits attributed reuse (for example, Creative Commons Attribution), it is permissable to first download such images, then reuse them under your own hardware for use in another website.
Warranties
All information provided by the Website is "as is". There is no warranty, to the extent permitted by applicable law, not even the implied warranties of MERCHANTABILLITY or FITNESS FOR A PARTICULAR PURPOSE.
However, if you have purchased a product or service from us, then our goods and/or services come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure. Self-termination
You may choose to delete your account and cease all use of the Website, in order to unbind yourself of having to comply with these Terms of Use.
The Privacy Policy shall remain in effect on any data we may have collected during your visits to this Site.
Regarding wiki accounts
For attribution reasons, you may not delete your account on any wiki. You may therefore not need to delete it in order to stop use of the Website.
Severability
Should any part of these Terms of Use be found to be unlawful, void or unenforceable, that part shall be limited to the minimum extent necessary to re-establish legality, and the remaining Terms of Use shall continue to be enforced to the extent permitted by applicable law.
Conflicts between translations and English version
Should any conflicts arise between the English language version of these Terms of Use, and any translation, the English version shall control.
